§ 1-2. Definitions and rules of construction.

  • In the construction of this Code and of all ordinances and resolutions of the town, the following rules shall be observed, unless otherwise specifically provided or unless such construction would be inconsistent with the manifest intent of the council:

    And, or. "And" may be read "or" and "or" may be read "and," if the sense requires it.

    Charter. The word "Charter" shall mean the Charter of the town, as it now exists or as it may be amended in the future.

    Code. Whenever the term "Code" or "this Code" is referred to, without further qualification, it shall mean The Code of the Town of New Market, Virginia, as designated in section 1-1.

    Code of Virginia. The term "Code of Virginia" means the Code of Virginia of 1950, as amended.

    Computation of time. Whenever a notice is required to be given, or an act to be done, a certain length of time before any proceeding shall be had, the day on which such notice is given, or such act is done, shall be counted in computing the time, but the day on which such proceeding is to be had shall not be counted.

    Council; town council. Whenever the words "council" or "town council" are used, they shall be construed to mean the council of the Town of New Market.

    County. The words "county" or "the county" shall mean the County of Shenandoah in the State of Virginia.

    Gender. A word importing the masculine gender only shall extend and be applied to females and to firms, partnerships and corporations as well as to males.

    Health officer. The words "health officer" shall mean the health director of the county health department or his duly authorized agent.

    May. The word "may" is permissive.

    Number. A word importing the singular number only may extend and be applied to several persons or things as well as to one person or thing; a word importing the plural number only may extend and be applied to one person or thing, as well as to several persons or things.

    Oath. The word "oath" shall be construed to include an affirmation in all cases in which by law an affirmation may be substituted for an oath.

    Officers, employees, departments, boards, commissions, agencies. Any reference to an officer, employee, department, board, commission or agency shall be construed as if followed by the words "of the Town of New Market, Virginia."

    Person. The word "person" shall include any individual, corporation, partnership, association, company, business, trust, joint venture, other legal entity or any group of individuals acting as a unit.

    Preceding; following. The words "preceding" and "following" mean next before and next after, respectively.

    Shall. The word "shall" is mandatory.

    Sidewalk. The word "sidewalk" shall mean any portion of a street between the curbline, or the lateral lines of a roadway where there is no curb, and the adjacent property line, intended for the use of pedestrians.

    State. The word "state" shall be construed as if the words "of Virginia" followed it.

    Street. The word "street" shall mean the entire width between the boundary lines of every way or place open to the use of the public for purposes of vehicular travel in the town, including the streets and alleys, and, for law enforcement purposes, the entire width between the boundary lines of all private roads or private streets which have been specifically designated "highways" by an ordinance adopted by the council.

    Swear; sworn. The words "swear" and "sworn" shall be equivalent to the words "affirm" and "affirmed" in all cases in which by law an affirmation may be substituted for an oath.

    Tense. Words used in the past or present tense include the future as well as the past and present.

    Town. The word "town" shall be construed as if the words "of New Market" followed it.

    Written; in writing. The words "written" and "in writing" shall be construed to include any representation of words, letters or figures, whether by printing or otherwise.
