§ 42-1. Containers generally.

  • (a)

    All owners, tenants or other persons within the town shall provide on their premises a container as described in this section for the collection and storage of garbage and refuse.

    (b)

    The containers shall be of metal, plastic or rubber construction and shall be equipped with a tight fitting cover of the same material so as to protect the contents from flies, dogs or other animals and shall be located to the side or rear of a dwelling, house or place of business satisfactory to the town manager and in such a manner as to be stationary so that the container will not be overturned or the top removed by dogs or other animals. Further, containers used for curbside trash pickup cannot have a capacity of more than 35 gallons nor weigh more than 65 pounds when loaded. Curbside trash pickup at each household is limited to no more than four 35 gallon containers or the equivalent in boxes, bags or bundles of brush per week. Brush can be no longer than four feet and must be securely tied and each such bundle of brush cannot exceed 65 pounds in weight.

    (c)

    All such refuse and garbage shall be disposed of at least once each week and more frequently if necessary to prevent odor or decay which would be injurious to the health of the community.

    (d)

    In order to protect the health and welfare of the public, the town shall have the right to send employees on the premises for the purpose of making inspection of such garbage.

    (e)

    No refuse or garbage shall be placed out for collection until the day prior to collection.

    (f)

    Any person violating the provisions of this section shall be guilty of a class 4 misdemeanor.
